NOTICE OF PUBLIC HEARING

​NOTICE IS HEREBY GIVEN that North Babylon Volunteer Fire Company, Inc., a New York membership corporation and volunteer fire department, also known as North Babylon Volunteer Fire Company (the “Fire Department”), will hold a public hearing at the request of and on behalf of the Town of Babylon (the “Town”), as required pursuant to Section 147(f) of the Internal Revenue Code of 1986 (the “Code”). The public hearing will be held on May 12, 2025, at 6:30 P.M., regarding the proposed plan of finance by the Fire Department to make renovations at certain of the Borrower’s fire station facilities, including, but not limited to (a) elevator construction at Fire Station 3, (b) installation of garage doors at all firehouses, (c) replacement of HVAC units at HQ and Station 3, (d) Replacement of a retaining wall at Station 3, (e) Replacement of Flooring at Station 2, and (f) Replacement of Outdoor lighting at HQ (collectively, the “Project”), which are owned and operated by the Fire Department exclusively for the benefit of the North Babylon Fire Protection District No. 15 (the “District”) pursuant to an arrangement between the Fire Department and the Town. The Project will be located at the following addresses: 3 Wallace Court, North Babylon, New York 11703; 397 Belmont Avenue, West Babylon, New York 11704; 20 Hale Road, North Babylon, New York 11703; and 187 Belmont Avenue, North Babylon, New York 11704; all within the jurisdictional boundaries of the Town and the District. The purpose of the Project is to increase accessibility to the upper level of the facility located at 3 Wallace Court and to address maintenance issues at the other facilities. As part of the proposed plan of finance for the Project, the Fire Department expects to enter into a tax-exempt debt obligation (the “Loan Agreement”) and use proceeds of the Lease to finance the costs of the Project. The maximum principal amount of the Loan Agreement will not exceed $1,550,000. The Fire Department expects that approximately $700,000. of the proceeds of the Loan Agreement will be allocated to the Project located at 3 Wallace Court, North Babylon, New York, with the remainder allocated among the other facilities, but may allocate up to $1,550,000 of proceeds of the Loan Agreement to pay costs of the Project at each address included in this public notice.

​At the public hearing, members of the public may appear in person to make or give oral or written comments in favor of or in opposition to the plan of finance for the Project and the Loan Agreement and/or the locations and nature of the Project. Handicapped persons who require assistance in attending the hearing or in furnishing comments, should contact Paul Miller, Financial Secretary of the Fire Department, at 631-540-0812 to request such assistance.

​Following the public hearing, approval of the plan of finance for the Project and the Loan Agreement by the Town Supervisor is necessary for the interest portion of loan payments under the Loan Agreement to be excludable from gross income for federal income tax purposes and in satisfaction of the requirements of Section 147(f) of the Code.
